Land Use Commission is Considering Rule Amendments

The Hawaii Land Use Commission, the body that decides petitions for land use district boundary amendments at the state level, is considering substantive amendments to its rules. For the proposed amendments in Ramseyer format click here, for its current rules click here.

Proposed amendments include relaxing the commission's adversarial, quasi-judicial process; amending the procedural processes for district boundary amendments and special use permits; changing they way declaratory orders are granted; and restricting the types of evidence and motions that are received by the commission.

For those adventurous enough, see whether the LUC rules stack up to the Hawaii Administrative Rules Drafting Manual, which was prepared by the Legislative Reference Bureau in 1984. Some agencies follow the manual, but some don't to the detriment of the poor souls who must navigate the agency regulatory process.
